A typical Trust is a common law vehicle which may not be appropriate in some civil law jurisdictions due to conflict in laws and potential tax inefficiencies. A foundation is a hybrid between a Trust and a Corporate vehicle and can be an effective means of wealth protection structuring where a traditional Trust would not be appropriate.

Additionally, some clients prefer the Foundation over a Trust as it has its own legal personality and will hold its own assets directly, subject solely to the rules of the Foundation, as opposed to the trustee holding Trust assets in a fiduciary capacity
