Tarian establishes bespoke trusts tailored to each family based upon their wishes and objectives. The majority of trust instruments are prepared in-house though in some complex cases (such as where there are beneficiaries in high tax jurisdictions) we will work with our trusted advisors to ensure the Trust is fit for purpose. In most cases, tax advice for the initial settlement is required and Tarian will either work with your existing advisors or its own global network to ensure that the Trust is formed in the most tax efficient manner.
Tarian acts as trustee and occasionally as protector for trusts established for the purposes of succession planning, estate planning, asset protection and retirement. Typically trusts are established with the proper law of Guernsey due to our expertise and the mature, modern trust laws where significant tried and tested precedent exists. The types of trust we are able to form and manage include:-
Discretionary Trusts;
Life Interest Trusts (one person enjoys during their life time and others following their life time);
Purpose Trusts;
Accumulation & Maintenance Trusts;
Charitable Trusts; and
Grantor Trusts.
Generally, it is not recommended that a Trust hold assets directly due to the Trust having no separate legal personality; inefficient tax planning; inability to ring-fence asset classes; and legal ownership of assets would be held in the name of the trustee. Ordinarily the Trust assets will only include shares in underlying subsidiary companies.
